Multi-Day Tours and Private Travel Arrangements

Booking Terms and Conditions

1. Introduction
These Terms and Conditions ("T&Cs") govern bookings and participation in multi-day tours and private or custom travel arrangements provided by Aesplore (Pty) Ltd ("Aesplore"). By booking or participating, you agree to these T&Cs.

2. Bookings and Reservations
2.1. A booking is confirmed once the required deposit or payment is received.
2.2. Once confirmed, the booking is a binding contract.
2.3. Customers are responsible for checking booking details and informing Aesplore immediately of any errors.

3. Payment Terms
Standard Multi-Day Tours
3.1. A 10% non-refundable deposit is required at the time of booking.
3.2. The balance is due 60 days before departure.
3.3. Failure to pay the balance may result in cancellation under the terms below.

Private and Custom Travel Arrangements
3.4. A 30% non-refundable deposit is required at the time of booking.
3.5. The balance is due 90 days before departure, unless otherwise agreed in writing.
3.6. Bookings made within 90 days of departure require full payment upon confirmation.
3.7. Stricter timelines apply because private arrangements may involve advance payments to suppliers.

4. Cancellations by the Customer

Standard Multi-Day Tours
4.1. Cancellation within 48 hours of booking: full refund.
4.2. More than 60 days before departure: 80% refund.
4.3. 30 to 59 days before departure: 50% refund.
4.4. Less than 30 days before departure: no refund.

Private and Custom Travel Arrangements
4.5. More than 90 days before departure: 70% refund.
4.6. 60 to 89 days before departure: 40% refund.
4.7. Less than 60 days before departure: no refund.
4.8. Refunds for private or custom travel may be further reduced to cover unrecoverable supplier costs, including accommodation, transport, or permits.

All Bookings
4.9. In accordance with the Consumer Protection Act (CPA), Aesplore may, at its discretion, consider partial refunds for serious unforeseen circumstances such as hospitalization or bereavement, less any unrecoverable costs.

5. Cancellations or Changes by Aesplore
5.1. Tours may be cancelled or rescheduled due to force majeure events, including severe weather, government restrictions, or pandemics.
5.2. Guests will be offered a full refund or the option to reschedule or receive credit.
5.3. Aesplore is not liable for costs beyond the tour fee, including flights, accommodation, or transfers.
5.4. For private or custom arrangements, refunds are limited to recoverable costs already paid to suppliers.

6. Travel Insurance
6.1. Comprehensive travel insurance is mandatory for all multi-day and private travel arrangements.
6.2. The insurance must cover cancellations, medical emergencies, personal injury, repatriation, and loss of property.

7. Liability and Indemnity
7.1. Guests accept the inherent risks of travel.
7.2. Aesplore and its staff are not liable for injury, illness, loss, or damage except where caused by proven gross negligence or willful misconduct.
7.3. Third-party providers such as hotels, restaurants, and transport operators are independent. Aesplore is not responsible for their actions.
7.4. Guests must act respectfully. Disruptive or unsafe behaviour may result in removal without refund.

8. Itinerary and Timing
8.1. Itineraries may change due to operational needs, traffic, weather, or safety concerns.
8.2. Aesplore will communicate changes as soon as reasonably possible.
8.3. For private or custom arrangements, itineraries are fixed once confirmed. Changes requested by guests may incur additional costs.

9. Complaints
9.1. Issues should be raised immediately during the tour so they can be addressed.
9.2. Formal complaints must be submitted in writing within 7 days of tour completion.

10. Data Protection
10.1. Aesplore complies with the Protection of Personal Information Act (POPIA).
10.2. Personal data is used only for booking purposes and will not be shared except where required to deliver services.

11. Force Majeure
11.1. Aesplore is not liable for cancellations or delays caused by events beyond its control.
11.2. In such cases, a refund or credit will be offered, less unrecoverable supplier costs.

12. Governing Law
12.1. These T&Cs are governed by South African law.
12.2. Any disputes shall be resolved in the jurisdiction of South African courts.

13. Written Cancellation Requirement
13.1. All cancellations must be submitted in writing and sent by email to info@aesplore.com or via WhatsApp to +27 (0)71 563 0175.
13.2. The cancellation date is effective when acknowledged by Aesplore in writing.
13.3. Verbal cancellations are not valid.
13.4. Guests are advised to request written confirmation for their records.
